General Statement

We endeavour to conduct all of our business in a fair and reasonable manner. Nonetheless, we need to define the terms under which we conduct business – this protects us and our customers by ensuring there is a clear and defined basis for our dealings with each other.

Before we wade into the legalese we wanted to specifically note that almost everything we offer is bespoke, and we pride ourselves on the unique types of services we can provide. Therefore please contact us if you would like to discuss any of the below, or have any specific requirements or questions relating to these – we will always do our best to accommodate you.

This statement does not constitute part of our formal terms of business, and is instead a reminder that we are not a faceless website but rather a business with an ethos of personal service!

Terms and Conditions of Business

These definitions and rules of interpretation shall apply to all terms and conditions within this document:

“Us”, “We” – The Ancestry Hunter, whose registered place of business is at 6A St Georges Road, Truro, TR1 3JE, UK;

“You”, “Buyer” – the person or business purchasing, or signifying interest in purchasing, services and/or products from The Ancestry Hunter;

“Goods”, “Products”, “Services” – The provision of genealogical services and preparation of reports, family trees and similar documents, the specific nature of which is defined in the individual contract offer we may make to You.

Any reference to a particular law is a reference to that law as it is in force at the time, taking into account any amendment, extension, application or re-enactment, and including any subordinate legislation as applicable at the time.

Please note that headings used in this document are for reference only, and do not affect the interpretation of any of these conditions.

Applicability of Terms

Any and all contracts made between Us and You shall be governed by these terms and conditions to the exclusion of all others, except where expressly agreed in writing with You on an individual basis.

If any part of these terms is found by any court or other body of competent jurisdiction to be wholly or partly invalid, illegal, unenforceable or void, it shall be deemed severable and all remaining provisions shall remain in full force and effect.

Any failure or delay by Us in enforcing any term or part thereof shall not be construed as a waiver of any of our rights under the contract.

All business with Us is conducted in England, subject to English law and the exclusive jurisdiction of the Courts of the United Kingdom.

We prepare and supply bespoke family histories that are custom-made to order. These are exempt from the normal right to return for goods purchased through “distance selling”, except where materially faulty. This does not affect your statutory rights.

When You make a purchase from Us, we will also need to request certain information in order to take your payment, and in the research and preparation of the goods and/or services you have purchased.

We will only use this data for the following:

  • Collating information on user experience of our website;
  • Processing your payment;
  • Researching your family history, and only when expressly commissioned to do so by You. Please note that the nature of genealogy is such that it may be necessary to share certain information with external parties as part of the normal research process, specifically and only in the direct course of providing a product or service that You have expressly commissioned from Us. By agreeing a contract with Us, You grant your express permission for Us to use your data as required in the legitimate course of the business activities we may undertake on your behalf.

We don’t like an inbox full of spam emails and “specially selected offers”, so we won’t assume you do either. We will thus never sell your data, nor shall we share it with any external parties except in the direct course of business performed on your behalf and at your direction, as per (3) above.

When You place an order, whether through this website, by email, or by telephone, it signifies your interest in purchasing one or more of our products and/or services. It does not constitute, nor shall it be construed as, our acceptance of any order or the agreement of a contract.

We will review each order upon receipt and assess the viability of any orders or requests, and upon completion of this initial review we will contact You to confirm whether we are able to accept the order, and to discuss and agree any amendments thereto that may be required. Once these details are agreed, a formal offer will be made by Us, specifying the particulars of the contractual agreement for the service we are offering.

Our products and services, including but not limited to the preparation of family trees and family histories, are sold with no warranty as to their accuracy.

We take a great deal of pride in the work we do, but the nature of genealogy and many historical data sources is such that it is not feasible to be certain of the veracity of all content beyond all doubt.

Family histories, family trees and related products and services are not intended to be used as factual sources for the purpose of any legal matter, including but not limited to those relating to identification of heirs, and/or disputes relating to wills and inheritances, and are not intended to satisfy evidentiary requirements for any criminal or civil legal matters.

In general where we find data that is known to be ambiguous or of questionable veracity we will endeavour to notify You of this, but no specific guarantee is offered or implied.

Furthermore we endeavour to portray factual details to the best of our knowledge and ability, but can accept no liability for the contents of the information provided – we relay the findings of the research you have asked us to undertake, and are not responsible for the specifics of these findings.

By ordering a product, You indemnify Us against any and all claims resulting from the preparation, content, and consequences thereof, of any product(s) and/or service(s) we may provide to You.

Please note that unless specifically instructed to the contrary, we will furnish You with all of the information that we have found in the direct course of our research in the preparation of your product, except where otherwise restricted by the Data Protection Act.

By commissioning product(s) and/or service(s) from Us, You accept that the content of these may include information of a varied nature that may hitherto have been unknown and/or forgotten by persons within the family tree in question, and that You do not hold The Ancestry Hunter liable for providing You with detail of this information, irrespective of its content.

Our prices are subject to change as we see fit, and may be revised without notice. The amounts detailed on our website are for indicative purposes only and do not constitute a contractual offer.

We will not start work on your order until we have received cleared funds to the total amount agreed within your contract.

For some products and services we may agree with You a staged payment scheme, the schedule for which will be agreed on an individual basis. Where we have agreed to conduct business on this basis, should there be a delay in receiving an agreed payment then we reserve the right to suspend further work on your order unless and until payment is received to bring your account up to date according to the agreed schedule.

Where an instalment-based payment plan has agreed, instalments shall be non-refundable.

Until your order is paid for in full, we retain ownership of all related products and materials, except where these have been provided to Us by You to assist with the research process.

The nature of the work we undertake is such that from time to time we may encounter circumstances in which specific goods and/or services need to be purchased in addition to those already budgeted for, in order to progress a specific aspect of research we are undertaking on your behalf – for example a Marriage Certificate to confirm the brides’ maiden name.

When such circumstances are encountered we will contact You to discuss the specifics applicable to the particular situation, and agree your preferred approach. In some cases we may need to apply extra charges for certain specific purposes, but we will not do so without first obtaining your consent to proceed and your agreement to any extra payment required.

We welcome customers from anywhere in the world. However, as our specialism is genealogical research rather than international tax law, we do need to note that any products we send to customers outside of the European Union may be subject to customs charges as applicable in the recipient’s place of residence. Any such charges are therefore the responsibility of the buyer, and furthermore we can accept no liability for delays encountered in the course of international shipping. Such orders are dispatched on a basis equivalent to Delivered Duty Unpaid (DDU), as defined by the International Chamber of Commerce’s Incoterms 2010. The place of Incoterm shall be the city, town or equivalent postal region as applicable, as detailed in the shipping address provided by You.

It is recognised by both parties that business may be impeded, delayed or otherwise interrupted by circumstances beyond The Ancestry Hunter’s control. We reserve the right to delay, defer or cancel part or all of a contract if prevented from performing Our obligations by factors beyond our reasonable control, including but not limited to acts of God, governmental actions, war or national emergency, acts of terrorism, protests, riots, civil commotion. Under such circumstances We will make every reasonable effort to fulfil all or part of the contract, but no warranty is offered or implied as to the extent to which this will be achievable, if at all.
